On January 18, 2016, the Anti-Corruption Agency forwarded, to the Ministry of Trade, Tourism and Telecommunications, the National Assembly and the Government, opinion on the Draft Law on Advertising. The version in Serbian language is available here.
The Anti-Corruption Agency considers necessary above other issues, to foresee, by legal provisions, obligation of state bodies to conduct advertising in media without contract services of other retailer agencies; to regulate clear criteria for the estimation of justifiability and intention of advertising of public authorities bodies and conclusion of contract on providing services without compensation between state bodies and media, as well as to forbid contract services of media promotion and advertising of public companies with market monopoly, except for advertising that is in direct link, i.e. upon which conduct of main activities of a concrete company depends. Although some of these issues are necessary to be more detailedly regulated by other regulations, it is necessary to regulate at least basic regulations on state bodies advertising, with special part of the Draft Law. This would enable implementation of some basic advertising rules, forseen by articles 4-20. of the Draft Law (i.e. ban on fostering discrimination and ban on advertiser discrimination) on advertising of state bodies and political organisations).
